Penalty rate details

第二，行为人与相对人之间的关系不同。行政处罚的决定者和实施者是具有国家行政管理职能的特定的行政机关，它与受处罚人之间不存在领导与被领导的隶属关系，而只存在管理与被管理的普通行政关系；行政处分的决定者和实施者并不一定是特定的行政机关，它与被处分人之间的关系是一种基于行政组织关系所产生的领导与被领导的关系。

第三，适用的法律依据不同。行政处罚依据国家有关行政管理的普通的法律法规，主要是指行政行为法和行政程序法；行政处分则依据行政组织法。

第四，形式不同。行政处罚的形式主要有警告、罚款、拘留、吊销许可证和执照、责令停产停业、没收财物、劳动教养等，始终与被处罚人的人身自由权、财产所有权等基本权利相关；行政处分的形式主要有警告、记过、记大过、降级、降职、撤职、留用察看、开除等，大多与被处分人职务上的权利有关。

第五，两者所产生的法律效果不同，由此产生争议后的救济手段也不一致。对行政处罚不服，相对人可以提起行政诉讼；对行政处分不服，相对人不能提起行政诉讼。
