我国刑事诉讼法第9条规定：各民族公民都有用本民族语言文字进行诉讼的权利。回人答民法院、人民检察院、公安机关对于不通晓当地通用的语言文字的诉讼参与人，应当为他们翻译。
翻译人员应当具备一定的条件：首先，能够胜任语言文字翻译工作，有为当事人及其他诉讼参与人提供翻译的能力。其次，应当与案件或者案件当事人无利害关系，否则应当回避。
翻译人员有权了解与翻译有关的案件情况;有权要求公安司法机关提供与翻译内容有关的材料;有权查阅记载其翻译内容的笔录，如果笔录同实际翻译内容不符，有权要求修正或补充;有权获得相应的报酬和经济补偿。
翻译人员依法应当实事求是，如实进行翻译，力求准确无误，不得隐瞒、歪曲或伪造，如果有意弄虚作假，要承担法律责任。此外，翻译人员对提供翻译活动所获知的案件情况和他人的隐私，应当保密。

只要是在当地工商局备案注册的正规翻译机构都具有司法翻译资格，相关司法部门需承认其合法性。
