Penalty rate details

環境行政處分是指環境保護行政單位的人員因違反環境與資源保護法所應受到的行政處分。

行政處罰是特定的國家行政機關對違反行政管理法律法規的公民、法人或者其他組織依法給予的制裁。

行政處罰與行政處分的主要區別在於：
第一，針對的違法行為不同。行政處罰是針對公民、法人或其他組織違反法律、法規的行為所採取的；行政處分是針對行政機關工作人員的違法失職行為所採取的。行政處罰是行政機關的外部行政行為；行政處分則是行政機關的內部行政行為。

第二，行為人與相對人之間的關系不同。行政處罰的決定者和實施者是具有國家行政管理職能的特定的行政機關，它與受處罰人之間不存在領導與被領導的隸屬關系，而只存在管理與被管理的普通行政關系；行政處分的決定者和實施者並不一定是特定的行政機關，它與被處分人之間的關系是一種基於行政組織關系所產生的領導與被領導的關系。

第三，適用的法律依據不同。行政處罰依據國家有關行政管理的普通的法律法規，主要是指行政行為法和行政程序法；行政處分則依據行政組織法。

第四，形式不同。行政處罰的形式主要有警告、罰款、拘留、吊銷許可證和執照、責令停產停業、沒收財物、勞動教養等，始終與被處罰人的人身自由權、財產所有權等基本權利相關；行政處分的形式主要有警告、記過、記大過、降級、降職、撤職、留用察看、開除等，大多與被處分人職務上的權利有關。

第五，兩者所產生的法律效果不同，由此產生爭議後的救濟手段也不一致。對行政處罰不服，相對人可以提起行政訴訟；對行政處分不服，相對人不能提起行政訴訟。
