證據資格：美國的證據規則

B. 求真相：翻譯法律文件是否需要知道本國的法律知識啊

當然好的翻譯前提之一就是通曉背景知識。但是有時候也不是所有翻譯都版能做到，但是至少做權到標准化，了解一定的法律知識。

其次要看同類型的文本，也就是平行文本，學習裡面的專業表達，無論是詞，短語，句子結構都要有樣學樣。

我是做法律翻譯，一直學的翻譯專業，不是法律專業。但我們是要學習法律知識，也要學習國外的相關法律制度，但也都是皮毛。做翻譯的過程中不斷在學習，慢慢就得心應手了。平行文本很重要！

在法律專業術語中有一些特定的翻譯方法，不能對其改變形式。所以這就要求譯員對專業術語非常的了解，遇到要匹配的術語，不能夠任意自創新詞，避免誤導讀者，引起誤差或爭議。

法律英語翻譯技巧

「開場白」、「結束語」以及「規定與罰則」是每一部法律法規必不可少的內容，掌握了這三個部分的翻譯，法律法規翻譯會變的簡單、容易的多。

一、「開場白」

下面便是一部典型的地方法規的卷首語：

第一條為加強市容和環境衛生管理，創造和維護整潔、優美的市容環境，保障人民身體健康，促進經濟發展和社會文明進步，根據有關法律、法規，結合本市實際情況，制定本條例。（摘自天津市市容和環境衛生管理條例）

開場白一般有四個雷打不動的組成部分。即「為了」、「根據」、「結合」、「制定」。根據英語行文特點，應該先翻譯「制定」，These Regulations are enacted（formulated），一般formulate用的多些，從英語詞義分析，enact似乎更加准確些。有學者主張把enact與 formulate一起用上。准確是准確了，但是畢竟顯得有點兒累贅。下面是譯文：

Article 1These Regulations are enacted in accordance with pertinent laws and regulations and in light of the concrete conditions of this Municipality，with the purpose of strengthening the administration of cityscape and environmental sanitation，creating and maintaining aclean，beautiful cityscape and environment，protecting people's health，promoting economic growth，civilization and progress of society.還有三處小地方需要說明一下。

1.條例也可以用單數。

2.「條例」與「本市」大寫的目的是為了醒目、突出，並與本條例中提到的另外一些條例加以區別。

3.With the purpose of或者with the aim to後邊都應該用動詞+ing的形式。

在開場白中，往往還有一些關鍵名詞的解釋，實施本法的范圍以及負責單位的任命等項內容。現分別說明如下：

關鍵名詞解釋：

第三條本條例所稱的勞動和社會保障（以下簡稱勞動保障）監察，是指勞動保障行政部門依法對用人單位和勞動者、就業服務機構、醫療服務機構遵守勞動保障法律、法規的情況進行監督檢查，對違反勞動保障法律、法規的行為依法進行處理的行政執法活動。（摘自《天津市勞動和社會保障監察條例》）

一是如上面的譯文所示「mentioned…refers to」，也可以翻譯成「be referred…shall be」；

「必須遵守本規定」或者「適用本規定」，可以一律翻譯成「apply to」，不要把前者翻譯成「must abide by」…

二、「結束語」

結束語首先要說，本條例從何時起生效，有的時候還要說明以前制定的某某條例同時廢止。請看上述有關市容條例的結束語以及譯文：

第五十九條本條例自公布之日起施行。1998年2月25目天津市第十二屆人民代表大會常務委員會第四十次會議通過的《天津市環境衛生管理條例》同時廢止。
