一、課程的地位、性質和任務(The Status, Character and the Teaching Purpose)
《法律英語》是依據《大學英語教學大綱》對大學英語應用提高階段在專業英語方面的教學要求,適應中國加入世貿組織後進一步擴大對外交流形式的需要,以培養更多既有扎實法律專業知識又精通外語的法律人才的需運桐求,所開設的法學專業本科必修課程的課程。
本課程以英美法為教學核心內容,包括英語法律術語、英美法系與大陸法系的比較、英美律師職業介紹、英美主要部門法、WTO 法律文件選讀、國際經貿法律、法學研究技巧與資源的運用。
本課程歷時一個學期,其教學目的旨在培養和提高學生在法律領域里應用英語的能力。在教師的指導下,學生通過閱讀一些精選的法律類英語文章掌握法學基本概念和基本理論以及專業術語。在教學過程中著重於擴大學生的專業詞彙量,提高學生的英語閱讀理解水平。同時,本課程採用個人發言和小組討論等多種形式以增加學生的語言實踐機會,晌拍使他們能將專業知識與英語知識很好地結合,最終具有較強的英語口頭交流能力和翻譯能力
According to the Teaching Criteria of the College English, Legal English, as a required course for the law school students, is aimed at training much more law experts whom are familiar with the foreign legal system.
The main content of this course is Anglo-American Law system, including the
legal terminology, the international business and trade law, the comparison between the Anglo-American law system and the Continental law system, the introction of legal profession, the legal departments of the Anglo-American, the supplementary reading material of WTO, and the techniques and sources for legal research (skills for presenting and legal writing).
Legal English lasts one semester with its purpose of developing students』 ability to take use of English in the legal field. With help of the teachers, the students can successfully master some basic legal terminology and theories, and in Law by reading some well-selected English legal essays. In process of teaching and learning, the emphasis is placed on enlarging students』 vocabulary in legal English and on raising their English reading comprehensive levels. Meanwhile, the course adopts indivial speeches or group discussions and other teaching methods in order to provide as more lingual practice as possible for students, helps them well-combine their knowledge both in major and English. At last, they can successfully complete the course study comparatively good English oral skills in communication and translation.

學生要重視其他各法律核心和專業課程的學習, 掌握基本法律知識和概念,在學習的同時還要對英美法律制度認真研習。

本課程在學習內容的安排上兼顧英語語言的學習應用和法律專業知識兩個方面。
(一)Introction to Legal English 導論(2課時)

(一)正確處理閱讀與聽、說、寫、譯的關系
(二)結合實際確定教學方法
外語學習歸根結底是學生自身的學習。課堂是學生語言實踐的重要場所。課堂教學不僅要擴大學生的語言知識,加強和提高學生的語言應用能力,還要幫助學生養成良好的課前預習學習習慣,培養自學能力。要讓學生懂得外語課是一門實踐課,要求學生主動參與,積極實踐,不斷積累。
(1)根據學生的專業情況和英語水平,授課過程中可增加一些閱讀或翻譯材料,並對每篇課文和課後練習內容進行靈活處理,以便更好地滿足法學專業學生的需求,完成本課程既定的教學任務並達到本課程既定的教學目的。
(2)課堂採用中英語授課。針對每個專題,將分三步進行:第一、背景知識介紹(中文);第二、閱讀與詞彙講解(英文);第三、口語訓練或課堂模擬(英文)
(3)教學過程中將運用多媒體教學, 圖文並茂地給學生展示英美法律
(4)教學過程中將組織學生觀看英文電影,讓學生通過影片了解英美法律制度,以激發其對法律英語學習的興趣
(三)重視教材在教學中的作用
要充分利用教材所提供的語言教材組織好課堂教學和指導學生課外自學。

法學屬於文科專業,但是文理科都是可以報考的。
❹ 我想學自學法律,不知道從哪開始學起應該先看什麼類型的書謝謝~~
我按照愛好自學法律的路子來說
(法律專業的同學們不在此列,他們要跟著教學大綱和教材走)
初入法門,你要培養、鞏固你對法律和法學的興趣,這是一門枯燥、繁雜、極為現實的學科,興趣是最好的動力,不堅持住的話要麼半途而廢,要麼學成個半吊子。
第一,法理學不要最開始學
容易被弄得暈頭轉向,然後喪失興趣,導致放棄。法理學是法學的靈魂,但你最好先具備一定的法學思維,然後才能碰它。
普通人與法律人的是非判斷、道德准則、思維方式不太一樣,這點你會逐漸明白的。
有些事情在法官看來順理成章,但大眾卻覺得匪夷所思;有些事情大眾覺得再正常不過,法官聽了卻一頭霧水。所以國內有些法院嘗試借鑒國外陪審團制度,在一些民商案件中,聘請相關行業從業人員,協助法庭分析某些「常理」性的問題。
第二,刑法學
推薦你看的頭一本書,張明楷《刑法學》,也就是俗稱「太皇太後」的那本。
刑法學可以激發每個人心中的正義感,堅定你的興趣,增長自學能力,這對於自學法律的人來說太重要了。
並且刑法學難度不大,完全可以自學,這本書篇幅很長,論述非常詳細,思路清晰,是國內刑法學著作裡面最優秀的一本。
假如連這本書都搞不定,那別的書也沒必要學了,純粹不適合學法。
第三,《刑事訴訟法學》
北大出版社的紅皮教材,在網上隨便一搜就找到了。刑法之後緊接著刑訴,思維連貫,學起來也容易。
第四,《憲法學》
這個也比較容易提起興趣,你肯定願意了解一下我國的部門組織機構。
當然這只是冰山一角,憲法是根本大法,是其他所有法律的「祖師爺」,必須要學的。
隨便誰的憲法書都可以看,但要注意書的版次,2018年我國通過了最新的憲法修正案,有些憲法書沒修訂,比較舊,不宜看。
(其實每本書都要注意版次,有多新就買多新的,畢竟法律三不五時就會修正,舊書中夾雜著過時內容)
第五,《行政法學》或者《行政訴訟法學》
跟在憲法後面,也算連貫吧,這兩本隨便看一本就行,也有把二者寫作同一本書的。
看似生活中有用,實際上沒什麼用(民告官的成功率閉著眼也能想到啊),稍微了解一下就行。
第六,《經濟法概論》
這本書可以給你打下堅實基礎,因為裡面涉及了公司法、合同法、稅法、票據法、保險法、知識產權法、勞動法等等,一大堆干貨。
你若問怎麼這會兒才排到《經濟法概論》呢?因為它太雜了啊,剛學法就往腦子里灌這么多東西,非迷糊不可。
現在你掌握了刑法、刑訴、憲法、行政法(或行訴),腦中搭起框架,再學經濟法概論就容易多了。
第七,《民法學》和《民事訴訟法學》
與生活息息相關,但自學有難度,因此直到現在才讓你接觸民法、民訴。
第八,《中國法制史》《外國法制史》《中國法律思想史》《西方法律思想史》
這四本屬於交叉學科(法學和史學),有興趣的話可以讀一讀。
其實,無論自學考試還是全日製法律本科,都有這四門課(有時也是法律專科的課程)
如果你是學歷史的出身,那這幾本可以略過了。
第九,《國際法》《國際私法》《國際經濟法概論》
對於前一個來說,你已經有了憲法、刑法的基礎。
對於後兩個而言,你學過了民法和經濟法概論。
有木有太輕松啊。
第十,《律師與公證制度》《法律文書寫作》
你不可能去當律師,現在司法考試門檻變高了,但是這兩本還是有用處的。
沒准哪天可以幫自己寫份律師函,省個1000大洋不成問題,哈哈(雖然律師函不是那麼好寫的)。
第十一,現在你可以看《法理學》和其他各種法律了。
你已具備法學本科的水平,以及法律人應有的思維和理性(雖然你暫時當不成法律人啦),知法懂法守法還是沒問題的。
當然,如果你時間精力充裕,也可以報名自學考試,你大學時公共課肯定過了吧,各省都有自考免考政策,以前成績合格的公共課一般能免考,直接考法學的專業課就行。
自考其實就是為了督促你學習,比較考驗毅力,你得有個堅持下去的理由。這些都通過了還能拿個第二文憑。假如你以前沒有學位證的話,還能趁這機會拿個學位證,現在這世道,證多不壓身。
我前面說過,法學是極為現實的學科。現實二字的意思,就是你不但要學會法律,還要學會如何善用法律保護自己。
壞人很狡猾,因此你要比壞人更狡猾。
至於書怎麼買,你去網店找就行啦,狗東、天貓都可以,或者找認識的學過法的朋友借書,也是可以的。
書盡量別一次買齊,買一本看一本比較好,免得增加太多心理壓力(看著厚厚一摞書肯定壓力山大),節省金錢(萬一堅持不下去了呢),最重要的是這些書足夠你學三四年以上,期間我國可能會修正法律,教材也會相應跟著修訂,你當初買了一大堆書,現在買新的也不是,接著看舊的也不好,兩難。
(如果不怕辛苦,去實體書店也行,只是教材類的在書店裡不太好找)
