限選都差不多 經濟法和民商法只不過是先學民法後學刑法..所以說西政法學本科基本是一樣的了

至於電腦問題 我覺得樓下說的太冠冕了...
電腦的確需要..但是真的用在上課的..不多吧......
第一.用來娛樂 個人覺得 經過高三,新生們需要用電腦來娛樂一下..大一稍微玩一下 不要等大二大三玩 那個時候玩不起,之後的課程很重要的說
第二 社團工作需要.大一難免加入各種各樣的社團,基本都需要電腦 特別是宣傳部(淚奔啊......1)
所以 如果你想在社團和學生組織里有一定地位 好好發揮余熱 提倡帶電腦
第三.方便需要...如樓下所說 選課需要電腦 總向別人借不方便.而且寢室里人都有電腦了..你自己沒有..有時候心裡會有落差的.
當然 還是那句話 如果家庭條件實在不允許 可以不用帶電腦.沒有電腦會看更多的書.
如果允許 那麼還是帶一個吧.差一點也無所謂 重要的是有一個方便 真的 方便.....

現在各種現行的民法教科書中，比如在彭萬林教授主編的《民法學》中{1}，民法總論邏輯結構包括民法的概念和適用、民法基本原則、民事法律關系、自然人、法人、合夥、法律行為、代理、訴訟時效和期限等九個部分；魏振瀛教授主編的《民法》{2}又將民法邏輯結構表述為緒論（包括民法概述、民法的基本原則、民事法律關系三部分）、民事權利主體、民事權利客體和民事權利變動等四個部分；而李開國教授的《民法總則研究》{3}將其分為民法的概念和性質、民法的本體、民法的基本原則、民事法律關系、民事主體、公民、法人、民事法律事實、民事法律行為、代理和訴訟時效等十一個部分。雖然他們對民法總論邏輯結構的排列各異，但無疑都將極大地推動民法總論的研究。對於民法總論的爭論實際上是對我國未來民法典總則內容的不同見解。眾所周知，現在大陸法系的民法典編撰體例主要有兩種：其一，羅馬式（又稱法學階梯式）；其二，德意志式（又稱為潘德克頓式）。羅馬式乃仿效古羅馬法學家蓋尤士的法學教科書。《法學階梯》（institutions）的體例，分為第一編人法、第二編物法和第三編訴訟法。法國民法典即採用這種體例。只是將訴訟法排除在外，以第一編人、第二編財產及對所有權的各種限制和第三編取得所有權的各種方法組成。潘德克頓（pandectae）式乃是德國學者著述中所用體例，為德國民法典所沿用，共分為五編：第一編總則、第二編債券、第三編物權、第四編親屬和第五編繼承。將兩種立法編撰體例相互比較不難發現：德國民法典與法國民法典最大的區別在於德國民法典有一個專門的總則部分，該部分所對應的學術內容就是我們現在所談的民法總論的一部分。

目前我國正處於民法體系化改革的關鍵時期，民事訴訟法的修改、擔保法的討論等一系列的立法活動無一不在為民法的制定作準備。隨著市場經濟的不斷發展，制定一部具有時代特色的民法典終將成為現實。怎樣才能使我國未來的民法典成為像法國民法典、德國民法典一樣的經典之作呢？筆者認為，關鍵之處在於要使民法典具有自己的靈魂，如前文所述德國民法典就是通過在民法中引入潘德克頓式的法學理念和立法體制，使德國民法典成為與法國民法典並列的大陸法系民法典代表。因此要使中國的民法典具有時代特點兼較高法律價值，我們就應當在民法的創新上下功夫。本文的寫作目的就是希望選取一個新的視角——從倫理人格主義哲學入手探尋民法總論邏輯結構的發展規律，為構建具有中國特色民法總論，進而為我國未來民法典的制定略盡綿力。

一、民法總論邏輯結構的概述

什麼是民法總論的邏輯結構？民法總論的邏輯結構是如何作用於民法總論？對民法典的制定將產生什麼樣的影響？要回答這些問題，首先要對民法總論的發展過程作一個簡要的闡述。近代民法一語。是從羅馬法之Jus civile-語沿襲而來，在法語為droit civil，英語為civil law，德語為Buergerliches Recht，荷蘭語為Burgerlyk Regt，其本意對應羅馬法的市民法之意。中國民法學者梅仲協在所著《民法要義》中指出：民法一語，典籍無所本，清季變法，抄自東瀛，東瀛則復從拿翁法典之droit civil，譯為今稱。其實不單是民法的語源，整個近代民法的體系都是建立在對羅馬法的研究之上。自從羅馬法古碑在義大利出土以來，通過對羅馬法的不同方法研究，大陸法系創造出兩種民法典編撰體例羅馬式（又稱法學階梯式）和德意志式（又稱為潘德克頓式）。潘德克頓（pandectae）一語，系羅馬法大全即查士丁尼法典中的《學說匯纂》的音譯，19世紀的德國民法學家通過對《學說匯纂》的研究形成了近代德國的民法理論體系，並且明確提出了將民法的原則
