刑法因果關系歷來是刑法理論上的一個重要問題，也是一個新論迭出的問題，在我國刑法學的研究當中，中外學者在對刑法因果關系進行研究的過程中，發表了諸多的專著和論文，由此亦在一定的程度上解決了刑法因果關系的許多問題，然而至今為止，有關刑法因果關系的紛爭並未停止，歷史上就有偶然因果關系說與必然因果關系說之爭，現在又有高概率之說、條件說、事實因果關系與法律因果關系區分說之論，這些觀點的出現，表明刑法因果關系的研究正在深化，為我們進一步研究開闊了視野，但同時又給了我們一種不是隔靴搔癢——抓不到實處，就是只提出問題卻沒有說明如何解決問題的淺嘗轍止的感覺，刑法學作為一門應用科學和解釋學，其立論的出發點應該是解決實際問題，作為刑法學的重要課題刑法因果關系的研究，當然也不能例外，但是，從我國目前有關這個問題的研究來看，情況似乎並不如此。而國外刑法因果關系的內容與結構與我國存在明顯的差異，美國刑法因果關系建立在判例法基礎之上，層次清晰、規則、體系完整。盡管目前刑法理論界不乏走出「必然性」與「偶然性」爭論困境的呼聲，但教學和司法層面仍然遵循原有理論。因此，有必要對我國因果關系理論進行重新思考，構建新的刑法因果關系理論。本文循著我國學者門在因果關系研究的蹤跡，借鑒國外有關方面的先進理論，從比較的角度，發現其中的問題，闡述我國刑法因果關系研究的不足之處，並對重新構建提出自己的一點意見和建議。關鍵詞：因果關系 英美法系 抗辯制度
