一、课程的地位、性质和任务(The Status, Character and the Teaching Purpose)
《法律英语》是依据《大学英语教学大纲》对大学英语应用提高阶段在专业英语方面的教学要求,适应中国加入世贸组织后进一步扩大对外交流形式的需要,以培养更多既有扎实法律专业知识又精通外语的法律人才的需运桐求,所开设的法学专业本科必修课程的课程。
本课程以英美法为教学核心内容,包括英语法律术语、英美法系与大陆法系的比较、英美律师职业介绍、英美主要部门法、WTO 法律文件选读、国际经贸法律、法学研究技巧与资源的运用。
本课程历时一个学期,其教学目的旨在培养和提高学生在法律领域里应用英语的能力。在教师的指导下,学生通过阅读一些精选的法律类英语文章掌握法学基本概念和基本理论以及专业术语。在教学过程中着重于扩大学生的专业词汇量,提高学生的英语阅读理解水平。同时,本课程采用个人发言和小组讨论等多种形式以增加学生的语言实践机会,晌拍使他们能将专业知识与英语知识很好地结合,最终具有较强的英语口头交流能力和翻译能力
According to the Teaching Criteria of the College English, Legal English, as a required course for the law school students, is aimed at training much more law experts whom are familiar with the foreign legal system.
The main content of this course is Anglo-American Law system, including the
legal terminology, the international business and trade law, the comparison between the Anglo-American law system and the Continental law system, the introction of legal profession, the legal departments of the Anglo-American, the supplementary reading material of WTO, and the techniques and sources for legal research (skills for presenting and legal writing).
Legal English lasts one semester with its purpose of developing students’ ability to take use of English in the legal field. With help of the teachers, the students can successfully master some basic legal terminology and theories, and in Law by reading some well-selected English legal essays. In process of teaching and learning, the emphasis is placed on enlarging students’ vocabulary in legal English and on raising their English reading comprehensive levels. Meanwhile, the course adopts indivial speeches or group discussions and other teaching methods in order to provide as more lingual practice as possible for students, helps them well-combine their knowledge both in major and English. At last, they can successfully complete the course study comparatively good English oral skills in communication and translation.

学生要重视其他各法律核心和专业课程的学习, 掌握基本法律知识和概念,在学习的同时还要对英美法律制度认真研习。

本课程在学习内容的安排上兼顾英语语言的学习应用和法律专业知识两个方面。
(一)Introction to Legal English 导论(2课时)

(二)结合实际确定教学方法
外语学习归根结底是学生自身的学习。课堂是学生语言实践的重要场所。课堂教学不仅要扩大学生的语言知识,加强和提高学生的语言应用能力,还要帮助学生养成良好的课前预习学习习惯,培养自学能力。要让学生懂得外语课是一门实践课,要求学生主动参与,积极实践,不断积累。
(1)根据学生的专业情况和英语水平,授课过程中可增加一些阅读或翻译材料,并对每篇课文和课后练习内容进行灵活处理,以便更好地满足法学专业学生的需求,完成本课程既定的教学任务并达到本课程既定的教学目的。
(2)课堂采用中英语授课。针对每个专题,将分三步进行:第一、背景知识介绍(中文);第二、阅读与词汇讲解(英文);第三、口语训练或课堂模拟(英文)
(3)教学过程中将运用多媒体教学, 图文并茂地给学生展示英美法律
(4)教学过程中将组织学生观看英文电影,让学生通过影片了解英美法律制度,以激发其对法律英语学习的兴趣
(三)重视教材在教学中的作用
要充分利用教材所提供的语言教材组织好课堂教学和指导学生课外自学。

法学属于文科专业,但是文理科都是可以报考的。

我按照爱好自学法律的路子来说
(法律专业的同学们不在此列,他们要跟着教学大纲和教材走)
初入法门,你要培养、巩固你对法律和法学的兴趣,这是一门枯燥、繁杂、极为现实的学科,兴趣是最好的动力,不坚持住的话要么半途而废,要么学成个半吊子。
第一,法理学不要最开始学
容易被弄得晕头转向,然后丧失兴趣,导致放弃。法理学是法学的灵魂,但你最好先具备一定的法学思维,然后才能碰它。
普通人与法律人的是非判断、道德准则、思维方式不太一样,这点你会逐渐明白的。
有些事情在法官看来顺理成章,但大众却觉得匪夷所思;有些事情大众觉得再正常不过,法官听了却一头雾水。所以国内有些法院尝试借鉴国外陪审团制度,在一些民商案件中,聘请相关行业从业人员,协助法庭分析某些“常理”性的问题。
第二,刑法学
推荐你看的头一本书,张明楷《刑法学》,也就是俗称“太皇太后”的那本。
刑法学可以激发每个人心中的正义感,坚定你的兴趣,增长自学能力,这对于自学法律的人来说太重要了。
并且刑法学难度不大,完全可以自学,这本书篇幅很长,论述非常详细,思路清晰,是国内刑法学著作里面最优秀的一本。
假如连这本书都搞不定,那别的书也没必要学了,纯粹不适合学法。
第三,《刑事诉讼法学》
北大出版社的红皮教材,在网上随便一搜就找到了。刑法之后紧接着刑诉,思维连贯,学起来也容易。
第四,《宪法学》
这个也比较容易提起兴趣,你肯定愿意了解一下我国的部门组织机构。
当然这只是冰山一角,宪法是根本大法,是其他所有法律的“祖师爷”,必须要学的。
随便谁的宪法书都可以看,但要注意书的版次,2018年我国通过了最新的宪法修正案,有些宪法书没修订,比较旧,不宜看。
(其实每本书都要注意版次,有多新就买多新的,毕竟法律三不五时就会修正,旧书中夹杂着过时内容)
第五,《行政法学》或者《行政诉讼法学》
跟在宪法后面,也算连贯吧,这两本随便看一本就行,也有把二者写作同一本书的。
看似生活中有用,实际上没什么用(民告官的成功率闭着眼也能想到啊),稍微了解一下就行。
第六,《经济法概论》
这本书可以给你打下坚实基础,因为里面涉及了公司法、合同法、税法、票据法、保险法、知识产权法、劳动法等等,一大堆干货。
你若问怎么这会儿才排到《经济法概论》呢?因为它太杂了啊,刚学法就往脑子里灌这么多东西,非迷糊不可。
现在你掌握了刑法、刑诉、宪法、行政法(或行诉),脑中搭起框架,再学经济法概论就容易多了。
第七,《民法学》和《民事诉讼法学》
与生活息息相关,但自学有难度,因此直到现在才让你接触民法、民诉。
第八,《中国法制史》《外国法制史》《中国法律思想史》《西方法律思想史》
这四本属于交叉学科(法学和史学),有兴趣的话可以读一读。
其实,无论自学考试还是全日制法律本科,都有这四门课(有时也是法律专科的课程)
如果你是学历史的出身,那这几本可以略过了。
第九,《国际法》《国际私法》《国际经济法概论》
对于前一个来说,你已经有了宪法、刑法的基础。
对于后两个而言,你学过了民法和经济法概论。
有木有太轻松啊。
第十,《律师与公证制度》《法律文书写作》
你不可能去当律师,现在司法考试门槛变高了,但是这两本还是有用处的。
没准哪天可以帮自己写份律师函,省个1000大洋不成问题,哈哈(虽然律师函不是那么好写的)。
第十一,现在你可以看《法理学》和其他各种法律了。
你已具备法学本科的水平,以及法律人应有的思维和理性(虽然你暂时当不成法律人啦),知法懂法守法还是没问题的。
当然,如果你时间精力充裕,也可以报名自学考试,你大学时公共课肯定过了吧,各省都有自考免考政策,以前成绩合格的公共课一般能免考,直接考法学的专业课就行。
自考其实就是为了督促你学习,比较考验毅力,你得有个坚持下去的理由。这些都通过了还能拿个第二文凭。假如你以前没有学位证的话,还能趁这机会拿个学位证,现在这世道,证多不压身。
我前面说过,法学是极为现实的学科。现实二字的意思,就是你不但要学会法律,还要学会如何善用法律保护自己。
坏人很狡猾,因此你要比坏人更狡猾。
至于书怎么买,你去网店找就行啦,狗东、天猫都可以,或者找认识的学过法的朋友借书,也是可以的。
书尽量别一次买齐,买一本看一本比较好,免得增加太多心理压力(看着厚厚一摞书肯定压力山大),节省金钱(万一坚持不下去了呢),最重要的是这些书足够你学三四年以上,期间我国可能会修正法律,教材也会相应跟着修订,你当初买了一大堆书,现在买新的也不是,接着看旧的也不好,两难。
(如果不怕辛苦,去实体书店也行,只是教材类的在书店里不太好找)
