㈠ 中華人民共和國刑事訴訟法111條規定立案後多久能破案

我國法律對立案後多長時間必須破案沒有規定。因為容易造就冤假錯案。設定破案期限不符合科學事實，定罪量刑要尊重事實，講究法律證據，一味地講究效率，會讓辦案質量下降，可能讓更多無辜之人遭受囹圄之苦。

㈡ 刑事訴訟法111條的具體適用問題

刑事訴訟法第一百一十一條規定的是檢察院對公安機關的一種立案監督權，具體內規定如下容：

第一百一十一條 人民檢察院認為公安機關對應當立案偵查的案件而不立案偵查的，或者被害人認為公安機關對應當立案偵查的案件而不立案偵查，向人民檢察院提出的，人民檢察院應當要求公安機關說明不立案的理由。人民檢察院認為公安機關不立案理由不能成立的，應當通知公安機關立案，公安機關接到通知後應當立案。
